Terms of Use
1. Scope
These Terms of Use govern the use of the Mini Caddie application (hereinafter referred to as the “App”) by its users. The operator and responsible person within the meaning of German law (§ 5 TMG) is:

2. Registration and Login
The use of the App requires authentication via Facebook Connect. Certain data are transferred from Meta Platforms Ireland Ltd. to us. As part of the login via Facebook Connect, additional profile information (e.g. the display name) may be transmitted to our authentication service and technically stored there in addition to the email address. We do not use this information for personalization, do not transfer it to our own profile data, and minimize or delete it after login where technically feasible. We use only the email address to create and manage the user account. Further information about data processing can be found in our Privacy Policy. Using the App implies your consent to these Terms of Use and the Privacy Policy.
3. Service Description
Mini Caddie provides registered users access to a web-based application that can be used after login. The App is provided free of charge. There is no entitlement to continuous availability or specific functionality.
4. User Obligations
Users agree to:
- use the App only for lawful purposes,
- not bypass or manipulate security mechanisms,
- and not infringe third-party rights (e.g., copyrights, privacy rights).
We reserve the right to suspend or delete accounts in case of violations.
5. Liability
We are liable only for damages caused by intent or gross negligence. In cases of slight negligence, we are liable only for breaches of essential contractual obligations (“cardinal duties”), and limited to foreseeable, typical damages. Liability for damage to devices or other property arising in connection with the use of the App is excluded insofar as such damage is not caused by intentional or grossly negligent conduct. The App is intended for the acoustic detection and analysis of sounds generated by dropping a ball near the device’s microphone. Using the App requires the device to be placed in close proximity to the falling ball. The safe placement of the device and the choice of a suitable environment are the sole responsibility of the user. To reduce the risk of damage, it may be advisable to use additional protective measures, such as protective cases or screen protectors. These recommendations do not constitute a guarantee of protection for the device and do not establish any further liability on the part of the operator. Use of the App is at your own risk.
6. Intellectual Property
All content, trademarks, logos, and other components of the App are protected by copyright. Any use, reproduction, or distribution outside the App requires prior written consent.
7. Termination
You may terminate your use of the App at any time by deleting your account or disconnecting Facebook Connect. This will deactivate your login, and your stored data will be deleted in accordance with legal requirements.
8. Changes to the Terms
We reserve the right to modify these Terms of Use when legal or technical changes make this necessary. Users will be informed in advance of any significant changes. Continued use of the App after the changes take effect constitutes acceptance of the revised Terms.
9. Governing Law
These Terms are governed by the laws of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The place of jurisdiction, where legally permissible, is Kiel, Germany.
